The E-2 Visa

The E-2 Visa is available to citizens of countries that maintain a treaty of commerce and navigation with the United States. The list of such countries might be found here. The E-2 visa allows investors to enter and work in the U.S. based on a substantial investment in a bona fide enterprise, where the investor holds at least 50% ownership or has operational control of the business. The important point of the investment is that the capital must be at risk of partial or total loss if the investment is unsuccessful. Unlike certain other visa categories, the E-2 does not require a fixed minimum investment amount; rather, the investment must be sufficient to ensure the successful operation of the business.
